Cyrus Engerer facing porn, computer misuse charges

http://www.timesofmalta.com/articles/view/20110726/local/Deputy-mayor-facing-porn-computer-misuse-charges.377402

I will never believe that the PN has done this – but whoever did it, it sure isn’t going to help people enter the political scene – such events are killing politics in Malta and we do not seem to be realizing that very soon we are going to have a major democracy defict;

  • if we do not get the right people in politics;
  • if we do not entice people into politics because they are going to give a service (rather than to become martyrs and to get themselves shot in the knee);
  • and, if we do not appreciate that it’s OK if allegiance is with the ‘principles’ first and foremost rather than with the Party….

I personally find this story developing arund Cyrus as disgusting and would encourage the PN to denounce it and show what the PN is made of….didn’t we all succumb to our curiosity and instincts at one point or another….being a politician doesn’t make you a saint…it doesn’t make you the devil either…

STATEMENT BY THE OFFICE OF THE PRIME MINISTER

Hereunder is a statement sent today by the Office of the Prime Minister to the MaltaToday Online.

“MaltaToday’s Claim is a Blatant Lie and is Completely Unfounded

Reference is made to your allegation that “fingers are being pointed” towards the Office of the
Prime Minister regarding the alleged leak of the charges against Cyrus Engerer.
This claim, which appears in MaltaToday online’s news report, is a blatant lie and is completely
unfounded. The Office of the Prime Minister categorically denies being in possession of, and
passing on, any such information to any media house.

The Office of the Prime Minister expects the Commissioner of Police to give an explanation of the
sequence of events that led to the issuance of the charges.

You are requested to publish this reply according to the provisions of the Press Act.”

Subject: Press Statement for Urgent Release
Statement by Mr Edgar Galea Curmi, Head of Secretariat of the Prime MinisterOn Friday 22 July late morning I received a phone call from Cyrus Engerer.   I took the phone call and promised Cyrus to phone him back as I was in a meeting.  I phoned Cyrus back around 1330 and, while speaking on the phone, I bumped into him outside the Xara Palace Hotel in Mdina.Cyrus told me that he was speaking to me as a friend because his father had been arrested.  This was the first time I got to know about Chris Engerer’s arrest.  Cyrus told me that his father’s lawyer, Dr. Carlo Bizazza, had told him that “he was to expect such incidents now that he had taken the plunge and resigned from PN.  I told him that I was only hearing about this incident from him and immediately phoned the Commissioner of Police, in front of Cyrus and in a way that he could hear every single detail of the phone call.

The Commissioner of Police stated to me that report on Cyrus’s father had been filed before Cyrus’s resignation from PN.  I explained to the Commissioner of Police what Cyrus had said that Dr. Bizazza had told him.  The Commissioner of Police categorically denied any relationship whatsoever between Cyrus’s resignation from PN and the arrest of Cyrus’s father.  I asked the Commissioner of Police to meet Dr. Bizazza and explain to him the facts.   I understand that the Commissioner of Police decided not to follow my request to meet Dr. Bizazza and I respect his decision.

All the above can be testified by the Commissioner of Police and Cyrus himself.

On a personal level, I am Cyrus’s Confirmation Godfather and care a lot for Cyrus and his family.  I am deeply upset by the way certain elements in the media are manipulating two unfortunate incidents of people I deeply care for with the sole aim of defaming the Prime Minister and the people around him. As a result of these malicious stories, I have instructed my lawyer to institute libel proceedings against MaltaToday.

Dr Debono claimed that whoever passed it on to the newspaper breached section 518 of the Criminal Code.

This states:

“the acts and documents of the courts of criminal justice shall not be open to inspection, nor shall copies thereof be given, without the special permission of the court, except by or to the Attorney General, by or to the parties concerned or by or to any advocate or legal procurator authorised by such parties; but any act, which is pronounced in open court, shall be open to inspection by any person, and copies thereof may be given on payment of the usual fee”.

Mr Engerer, who insisted that he had always acted in the most correct manner, said that the way things turned out was also in breach of the Constitution because of the prejudicial advertisement of the case.

Art 39 (4) (c) (ii) of the Constitution states that:

“Nothing in sub-article (3) of this article shall prevent any court or any authority such as is mentioned in that sub-article from excluding from the proceedings persons other than the parties thereto and their legal representatives, where it may be empowered or required by law to do so in the interests of defence, public safety, public order, public morality or decency, the welfare of persons under the age of eighteen years or the protection of the private lives of persons concerned in the proceedings.”

  1. ‎’I will never believe that the PN has done this’ – they already did it twice (remember Harry Vassallo and Nikki Dimeck + half Sliema Council?) so why not to Cyrus. It worked perfectly in both cases so why not now?

    • The issue is simpler than what it has been inflated to be… Engerer was interrogated on 23rd June (for an issue in his personal life)…knowing that with a court case on his head, the party would ask him to resign and he would eventually lose his post as deputy major, he had to anticipate with another move..ie resign before they ask him to and try and keep a low profile (or rather hide) the case…he was the prime activist in the ousting of Nikki Dimech….and now he got himself in the same position…or at least that is what the simple facts reveal…police handling, party, prime minister statements etc are just the decoration.
